End User License Agreement

This End User License Agreement ("Agreement") is between you and Crafted Life ("Licensor") and covers the WriteBand web app and the WriteBand mobile apps (together, the "App"). Your use of the App is also subject to our Terms of Use and Privacy Policy. If you obtained the App from the Apple App Store, the sections marked "App Store" below also apply.

1. Licence

Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial study, on devices you own or control and, for the mobile apps, as permitted by the usage rules of the app store you obtained it from. The App is licensed, not sold.

2. Restrictions

You may not copy, modify, distribute, sell, rent or sublicense the App; reverse engineer or decompile it except where the law allows; remove proprietary notices; or use it in a way that breaks the Terms of Use or the law.

3. Ownership

The App, its content (excluding your own essays) and all related intellectual property belong to Licensor. This Agreement grants no rights other than those stated in it.

4. Purchases

On the web, purchases are processed by Polar as Merchant of Record. In the mobile apps, purchases are made through the app store and follow its terms and refund rules.

5. Maintenance and support (App Store)

Licensor alone is responsible for maintenance and support of the App. Contact [email protected]. You acknowledge that Apple has no obligation to provide any maintenance or support services for the App.

6. Warranty (App Store)

The App is provided "as is", to the extent the law allows. Licensor is solely responsible for any product warranty that cannot be excluded by law. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are Licensor's responsibility.

7. Product claims (App Store)

Licensor, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

8. Intellectual property claims (App Store)

If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, Licensor, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.

9. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-party terms

You must comply with applicable third-party terms (for example your mobile carrier's) when using the App.

11. Third-party beneficiary (App Store)

Apple and its subsidiaries are third-party beneficiaries of this Agreement, and once you accept it, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

12. Termination

This Agreement applies until you or Licensor end it. It ends automatically if you break it. When it ends you must stop using the App and delete any copies.

13. Limitation of liability

To the extent the law allows, Licensor is not liable for indirect, incidental, special or consequential damages arising from your use of the App, and its total liability is limited to the amount you paid for the App and in-app purchases in the 12 months before the claim.

14. Governing law and entire agreement

This Agreement is governed by the laws of Vietnam, without prejudice to mandatory consumer protection rules of your country of residence. Together with the Terms of Use and Privacy Policy, it is the entire agreement between you and Licensor about the App.
